These Terms of Service ("Terms") govern access to and use of ProClimber Simulator (the "Game"), operated by [ENTITY NAME], a company organized under the laws of Latvia (or, before that company is registered, the individual developer operating the Game — see the naming and entity notes for current status). By creating a profile or playing the Game, you accept these Terms.
1. Eligibility and age
The Game is rated PEGI 12 / ESRB Teen. An age prompt runs once, on first session, before any purchase becomes possible. Accounts for players under 13 are not supported (see our Privacy Policy for why). Players between 13 and 17 may play with a parent or guardian's permission and are subject to reduced monthly purchase limits.
2. Accounts
An account starts as a device-linked guest profile; progress lives on that device. You may optionally link a Google account to sync progress across devices. You are responsible for activity on your account and for keeping any linked credentials secure. One account per person; account sharing or transfer is not permitted.
3. In-game currency and purchases
The Game uses a single purchasable currency, Tops & Clips (Ŧ, where Ŧ1 = ¢100). At the time of writing, the store is not yet open — this section describes the terms that will apply once it does.
- All purchases are direct and fixed-price. There are no loot boxes, gacha mechanics, or randomized rewards of any kind.
- Monthly purchase caps apply: [Ŧ200 for adult accounts, Ŧ100 for minor accounts], enforced server-side regardless of payment method.
- Tops & Clips have no cash-out value and cannot be exchanged for real currency outside the Game.
- Refunds follow the policies of the platform you purchased through, plus applicable law, including the EU right of withdrawal for digital content and additional protections for unauthorized purchases made by a minor. [full refund procedure - pending legal review].
4. User-generated content
Chat messages, route names, gym names, and any future mod content ("UGC") must follow our community rules: no harassment, no impersonation, no illegal content. Submitted UGC is filtered on submission and reviewable and revocable server-side at any time. You keep ownership of original UGC you create, but you grant [ENTITY NAME] a worldwide, royalty-free license to host, display, and moderate it as part of operating the Game.
Reports of abusive UGC or player conduct are reviewed by a human within 72 hours of submission (see §6). This is our notice-and-action mechanism under the EU Digital Services Act.
5. Acceptable use
You agree not to: cheat, exploit bugs for unintended advantage, use unauthorized third-party software (aimbots, macros, packet manipulation), harass other players, or trade accounts or currency for real money outside channels we operate.
6. Enforcement
Violations follow an escalating ladder: warning, mute, temporary suspension, permanent ban. Competition-integrity violations (cheating in scored climbs) are enforced separately from chat/conduct violations and can result in a ban without a prior warning.
7. Connectivity
The Game is online-centric: the shared world, marketplace, competitions, and social features require a live connection to our servers and are not available offline. A separate, capped offline training mode is available for solo conditioning sessions when disconnected; it does not carry over to competitions, sends, or the marketplace.
8. Intellectual property
The Game, its assets, and its software are owned by [ENTITY NAME] or its licensors. Map data is used under the Open Database License, © OpenStreetMap contributors. These Terms grant you a limited license to play the Game; they do not transfer ownership of anything in it.
9. Termination
You may stop playing at any time. We may suspend or terminate an account for a Terms violation, legal requirement, or discontinuation of the Game, with notice where reasonably possible. Purchased currency not yet used at termination is handled per applicable consumer law.
10. Disclaimers and liability
The Game is provided "as is." To the extent permitted by law, [ENTITY NAME] disclaims warranties of uninterrupted or error-free operation and limits liability for indirect or consequential damages. Nothing here limits liability that cannot be excluded under applicable law.
11. Governing law

12. Changes to these Terms
We may update these Terms as the Game develops, particularly around the store, competitions, and UGC systems. Material changes will be flagged in-game before they take effect.
